Terms and conditions
These terms govern the use of this website and the general basis on which 338 Solutions Limited engages with clients. The specific terms of any piece of work will be set out in a separate written engagement, which will take precedence over this page in the event of any inconsistency.
1. About the firm
338 Solutions Limited is a private security firm registered in England and Wales. The firm is licensed by, and operates under, the Security Industry Authority and all relevant United Kingdom security regulations. A registered address and company number are available on request and appear on all formal engagement documents.
2. The services we provide
338 Solutions is a security consultancy firm. The scope of any particular engagement is defined in the relevant written contract.
We reserve the right to decline any engagement that, in our judgement, falls outside the kind of work we are willing to undertake, and to do so without giving detailed reasons. This includes but is not limited to engagements that in our view may place our operators, the client, or a third party at disproportionate risk, or that conflict with our professional, ethical, or legal obligations.
3. Specialist partners
Some aspects of an engagement may be delivered, in whole or in part, through trusted specialist partners selected by 338 Solutions for their specific capability, geography, or operational depth. Where this is the case, the arrangement is coordinated by 338 and the overall delivery of the engagement remains the firm's responsibility to the client.
4. Client responsibilities
Clients are asked to provide accurate and complete information relevant to the engagement, to notify the firm promptly of any change in itinerary, circumstances, or risk picture, and to cooperate in good faith with the firm's operators and planning.
During an engagement, clients and those accompanying them are asked to follow reasonable instructions given by the firm's personnel where those instructions are issued in the interests of safety. The firm's ability to provide effective protection depends on this cooperation, and in its absence the firm reserves the right to withdraw from the engagement.
5. Fees and payment
Fees for each engagement are confirmed in writing in advance, in the engagement contract or in a separate fee schedule. Payment terms are set out in the contract. Late payment may, at the firm's discretion, result in the suspension of services until the position is resolved.
6. Cancellation and rescheduling
Cancellation by the client must be made in writing. Cancellation terms are set out in the engagement contract and typically reflect the short notice and bespoke nature of protective work. Cancellation by the firm, for reasons of safety, operational viability, or other exceptional circumstances, will be communicated as early as possible, and the firm will work with the client to reschedule or to refund fees where appropriate.
7. Confidentiality
Information shared with the firm in the course of an engagement is treated as confidential and will not be disclosed to third parties except where disclosure is required by law, is made to specialist partners acting on the firm's behalf under equivalent obligations of confidentiality, or is made with the client's consent. The firm expects reciprocal confidentiality from clients in respect of the firm's operators, methods, and arrangements.
8. Data protection
The firm handles personal data in accordance with the United Kingdom General Data Protection Regulation and the Data Protection Act 2018. Personal data provided during an engagement is used only for the purposes of delivering that engagement and meeting the firm's legal obligations, and is retained only for as long as is necessary. 9. Photography, recording, and the use of technology
The firm and its operators may, in the course of an engagement, record certain information as part of standard operational practice. This may include written logs, photographic or video records relevant to the security picture, and technical data gathered for the purposes of the engagement. Such records are handled in accordance with the confidentiality and data protection provisions above and are not used for marketing purposes. Specific arrangements for recording and the retention of records will be set out in the engagement contract.
10. Liability
The firm takes reasonable care in all aspects of its work. It is, however, the nature of security work that no provider can guarantee absolute protection against all possible events, and the firm's liability is therefore limited as set out in the engagement contract.
Nothing in these terms or in any engagement contract is intended to, or will, limit or exclude the firm's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded under the laws of England and Wales.
11. Use of this website
This website is provided for general information about the firm. The information on the site does not constitute an offer to provide services, and no client relationship is created until a written engagement contract has been signed. The firm takes reasonable care to ensure that the information on the site is accurate at the time of publication but accepts no liability for any reliance placed on the site.
12. Changes to these terms
The firm may update these terms from time to time. The version of the terms in force is the version published on this page at the date of access. Where a change is material, the firm will endeavour to communicate it to clients with whom an engagement is in place at the time.
13. Applicable law and jurisdiction
These terms, and any engagement contract entered into with the firm, are governed by the laws of England and Wales. Any dispute arising in connection with them is subject to the exclusive jurisdiction of the courts of England and Wales.
